Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MMO Gamer's Market website and services ("we", "us", "our"). By accessing our site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services. Please read them carefully, as they include important provisions about the nature of the digital goods we sell, how delivery and payment work, and limitations on our liability.

Eligibility and age

You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to use our services. By placing an order you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms. We may refuse service, close accounts, or cancel orders at our discretion where we believe this requirement is not met.

Accounts

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for all activity that takes place under your account. You must notify us promptly if you suspect any unauthorised use. We may suspend or terminate accounts that violate these Terms, are used for fraud or abuse, or that we reasonably believe pose a risk to us, our users, or third parties.

Nature of the goods and how delivery works

We sell digital in-game items, including virtual currency, gold, gems, coins, and cosmetic items, for online games. These are intangible digital goods, not physical products, and nothing is shipped by post. Orders are placed online, after which payment and delivery are arranged with one of our human agents through live chat or Discord.

Delivery is performed manually in-game by our agents and requires your cooperation, including providing accurate delivery details such as your server, faction, character, platform, or account handle, and being available to complete the in-game hand-off where a game requires it. Delivery times are estimates and may vary depending on the game, stock, and your availability. Because delivery is coordinated through chat, we may contact you to confirm details before completing your order.

Pricing, payment, and order acceptance

Prices are shown on the site and may change at any time before an order is confirmed. All payments are handled manually and confirmed by an agent. We currently accept PayPal, Bitcoin (BTC), USDT (TRC20), USDT (ERC20), and Skrill. We do not operate an automated card gateway and we do not store card data. Payment is arranged with an agent after you place an order, and your order is processed once we have confirmed that payment has been received.

Placing an order is an offer to purchase, which we may accept or decline. We reserve the right to refuse or cancel any order, for example where we suspect fraud, where an item is unavailable, where a pricing error has occurred, or where accepting the order would breach these Terms or applicable law. Where we cancel a paid order that we cannot fulfil, we will arrange a refund as described in our Refund & Dispute Policy.

Acceptable use and prohibited conduct

You agree not to use our services to engage in, or in connection with, any of the following:

  • fraud, payment fraud, identity misuse, or any form of chargeback abuse;
  • using stolen, unauthorised, or compromised payment methods or accounts;
  • reselling, exploiting, or trafficking items that were obtained through prohibited, illegitimate, hacked, exploited, or otherwise unlawful means;
  • harassment, threats, abusive behaviour, or spam toward our staff or community;
  • attempting to disrupt, attack, reverse engineer, or gain unauthorised access to our systems;
  • any activity that is unlawful in your jurisdiction or that violates applicable export, sanctions, or anti-money-laundering rules.

We may refuse, suspend, or terminate service and report activity to relevant authorities where we reasonably believe these rules have been broken.

Game terms and account risk

The buying, selling, and trading of in-game items may be restricted or prohibited by the terms of service of individual games and their publishers. We are not affiliated with, endorsed by, or sponsored by any game publisher. You are solely responsible for understanding the rules that apply to the games you play and for deciding whether to use our services in light of those rules. You acknowledge that using third-party item services may carry a risk to your game account, including suspension or banning by the publisher, and you accept that risk. We do not control and are not responsible for actions taken by game publishers against your account.

Refunds

Because we sell digital goods that are delivered in-game, refunds are handled on a case-by-case basis. Once items have been delivered, a transaction is generally final. Intellectual property and trademarks

All game names, logos, characters, and related trademarks are the property of their respective owners and are used here for descriptive and identification purposes only. Their use does not imply any affiliation with or endorsement by those owners. The content, design, and branding of the MMO Gamer's Market website are our property or that of our licensors and may not be copied or used without permission.

Disclaimers

Our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that our services will be uninterrupted, error-free, or that any particular item will remain available. We make no warranty regarding the continued availability, value, or behaviour of any in-game item, which depends on factors controlled by the relevant game publisher and outside our control.

Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or game-account standing, arising out of or in connection with your use of our services. To the extent we are found liable, our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of our services, or your violation of any law or the rights of any third party, including any game publisher.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise these Terms and, where appropriate, provide additional notice. Your continued use of our services after an update means you accept the revised Terms.

Governing law and disputes

These Terms are governed by general principles of international commercial and consumer law. Where the law of your place of residence grants you mandatory consumer protections, nothing in these Terms removes those rights. We encourage you to contact us first so we can try to resolve any dispute informally and in good faith before pursuing other remedies.
